Terms of Service

1. The Service

Yaadgar creates personalised surprise websites delivered as shareable web links. Each website is custom-built using the photos, music, messages and details you provide over WhatsApp.

All surprise websites are hosted online and accessible on any smartphone browser. No app or software download is required by the recipient.

2. Ordering Process

An order is confirmed when:

• You have shared all required details with us over WhatsApp
• Payment has been received in full via UPI

We begin building your personalised surprise website only after payment is confirmed. You will receive a preview screenshot or screen recording for approval before the final shareable link is delivered.

3. Pricing and Payment

• All prices are listed in Indian Rupees (INR) inclusive of all charges
• Payment is accepted via UPI (GPay, PhonePe, Paytm) only
• Full payment is required before work begins
• Prices are subject to change — the price at time of order confirmation applies

4. Refund and Cancellation Policy

Because each surprise website is custom-made specifically for you, we have a strict no-refund policy once work has begun.

• Full refund: Only if you cancel before we have started building — before we acknowledge receipt of your details.
• No refund: Once building has started, no refunds are issued under any circumstances.
• Delivery failure: If we are unable to deliver within the agreed timeframe due to our fault, you are entitled to a full refund.

We strongly recommend reviewing the preview we send before sharing the link. Once the final link is delivered and opened by the recipient, the order is considered complete.

5. Delivery Timelines

• Prime (₹499): Delivered within 2 hours of receiving all details and payment.
• Elite (₹799): Delivered within 2 hours with priority delivery and 1 free revision within 24 hours.

During peak seasons (Valentine's Day, Friendship Day, etc.) delivery may take up to 6 hours. We will always communicate any delays proactively over WhatsApp.

6. Revisions Policy

• Minor text corrections: (name spelling, message typos) are free on all plans within 24 hours of delivery.
• Elite (₹799): Includes 1 free revision within 24 hours covering content changes, photo replacements or structural updates.
• Major revisions on Prime: Available at an additional fee of ₹50–₹150 depending on scope.
• Revision requests after 24 hours: May be subject to additional charges.

7. Hosting and Link Validity

• Prime websites are hosted for 3 months from delivery date
• Elite websites are hosted for 1 year from delivery date
• We will notify you before the hosting period expires
• Hosting renewal is available at a nominal fee
• We reserve the right to take down content that violates these terms

8. Customer Responsibilities

By placing an order, you confirm that:

• You own or have permission to use all photos and content you provide
• The content you share does not violate any third-party rights
• You will not use our service to create hateful, explicit, defamatory, or illegal content
• The personal details you provide are accurate to the best of your knowledge

We reserve the right to refuse any order we determine, at our sole discretion, to be inappropriate or in violation of these terms.

9. Intellectual Property

The design, code and structure of each personalised surprise website is the intellectual property of PixelApp Studio. The personal content (photos, messages, names) within the website belongs to you.

We may use anonymised, non-identifiable descriptions of projects for marketing purposes. We will never share your actual photos, messages or personal details publicly without your explicit written consent.

10. Limitation of Liability

Yaadgar and PixelApp Studio are not liable for:

• Emotional outcomes or recipient reactions
• Technical issues on the recipient's device or browser
• Loss of data due to circumstances beyond our control
• Indirect or consequential damages of any kind

Our total liability shall not exceed the amount you paid for the specific order in question.

11. Changes to These Terms

We may update these Terms of Service at any time. The version in effect at the time of your order applies to that order. Continued use of our service after changes are posted constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Madhya Pradesh, India.
